Terms and Conditions
The promoter of this competition is Edward Snell & Co. Ltd, distributor and representative of Remy Cointreau Portfolio of Brands in South Africa.
Acceptance of these terms and conditions is a condition of entry to the competition. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
A. HOW TO ENTER
i. The competition runs from 10:00AM GMT on July 1st to 10:00PM GMT on 1st December 2016.
ii. All competition entries must be received by Cointreau by no later than 10:00PM GMT on 1st December 2016. All competition entries received after that time will not be accepted.
iii. To enter the competition you must submit your creative project online at http://www.cointreau.com.ng/thegrant/form by filling out the registration form and providing us with details (in writing) about your talent and how you feel winning the Cointreau Creative Crew Grant will help you to achieve your dreams.
iv. There is a limit of one entry to the competition per person. Duplicate entries will not be counted.
v. Cointreau does not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including for example, as a result of any technical malfunctions and/or any network, server, computer hardware or software failures of any kind.
vi. No purchase is necessary.
i. The competition is open to anyone aged 21 years and over, except employees of Cointreau (or its associated and affiliated companies) their families, agents or any third party directly associated with administration of the competition.
ii.By entering the competition, you confirm that you are eligible to do so and eligible to claim the prize (in particular, you must be available to attend the events detailed below).
iii. Cointreau may require you to provide proof of your identity and that you are eligible to enter the competition – you agree to cooperate with such enquiries.
iv. Cointreau will not accept competition entries that are automatically generated by computer, completed by third parties or in bulk, illegible, have been forged or tampered with, or incomplete.
v. By entering the competition you confirm that your project, entry form and any accompanying materials and submissions:
- do not contain any material which is defamatory of any person or which is obscene, offensive, hateful, inflammatory or deceitful;
- do not promote sexually explicit material, violence or any illegal activity;
- do not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- do not infringe any rights of any other person or breach any legal duties owed to third parties;
- are not threatening, abusive or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
- are not likely to harass, upset, embarrass, alarm or annoy any other person;
- are not used to impersonate any person, or to misrepresent your identity or affiliation with any person;
- do not give the impression that they emanate from Cointreau; or
- do not advocate, promote or assist any unlawful act such as (by way of example only) copyright or trade mark infringement or computer misuse.
vi. Cointreau reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition or if (in Cointreau’s opinion) you are in breach of these terms and conditions.
i. Cointreau’s Creative Committee will select the top twenty most creative applications from 2nd December 2016 to be announced at the end of that month. Selection for the top10 finalists will commence from the 1st of January 2017.
ii. The ten finalists will then be invited to attend a Cointreau Creative Crew mentorship ceremony on or before 1 February 2017.
The awards ceremony is planned to take place in Johannesburg in April 2017, date is TBC.
iii.If any finalist and/or winner cannot attend the presentation event or awards ceremony their entry will no longer be considered for the grant, and a new finalist or winner will be selected.
iv. Cointreau’s expert committee and grand jury will make their decisions on the basis of each project’s creativity and how entrants embody the values of the competition.
v. The selection of the finalists and the grant winner is final and no correspondence or discussion will be entered into regarding their selection.
vi. The ten finalists invited to the Cointreau’s awards ceremony may bring a friend or family member as a guest. Guests must be aged 21 or over. Guest invites cannot be sold or traded for value to third parties. Cointreau may withdraw invitations if a finalist breaches these terms and conditions (whether such breach is actual or suspected).
vii. There is no cash alternative for the invites and the invites are not negotiable or transferable.
D. THE GRANT
i.The grant winner will be awarded a grant of R100 000 to pursue the creative vision set out in their entry. The grant will be paid to the winner in installments. The timescale for the payment of the installments and the amount of each installment will be at Cointreau’s discretion and will depend on the nature and requirements of the winning entry.
ii.The grant may only be used in pursuance of the winning project. The winner of the grant will be required to sign a contract with Cointreau (the terms of which will be determined by Cointreau) making it clear how the grant will be spent. Cointreau will be entitled to withhold payment of any installment of the grant (and to require repayment of any installments) in the event of a breach of the contract by the winner.
E. LIMITATION OF LIABILITY
i.Insofar as is permitted by law, Cointreau, its employees, agents and distributors will not in any circumstances be responsible or liable for any costs, claims or losses howsoever caused that arise by reason of any person's entry into the competition or the award, or non-award, to them of a prize. This does not exclude Cointreau’s liability for personal injury or death where it is caused by the negligence of Cointreau or its agents or employees. Your statutory rights are not affected.
i. All competition entries and accompanying material submitted to Cointreau will become the property of Cointreau on receipt and will not be returned.
ii. You agree that Cointreau may make any part of your project entry and accompanying materials available as it sees fit to publicise and promote the competition, including but not limited to making them available on its Website, on any social media platforms and at any events promoting or related to the competition. You agree to grant Cointreau a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights, in your project entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license them for such purposes.
iii. You consent to Cointreau recording your attendance at any event relating to the competition (and copying, editing and publishing those recordings for any purpose) and you agree that, in return for your participation in the competition and attendance at those events, any material you generate as part of your attendance at those events will be owned by us for any purpose.
iv. You agree to waive your moral and performers’ rights in respect of your project entry, accompanying materials and attendance at any events relating to the competition in favour of Cointreau for Cointreau’s use for the purposes of this agreement.
G. DATA PROTECTION AND PUBLICITY
i. By entering the competition, you agree that any personal data supplied to or obtained by Cointreau in connection with the competition (including your name, image, social media account and contact details) may be used by Cointreau, its agents, partners and/or any third party suppliers (as applicable) in connection with the administration of the competition and for any other reasonable and related promotional purposes.
ii. Your email address may be used to contact you about the competition, Cointreau’s products, projects Cointreau are running. If you win, you further agree to participate in any reasonable publicity required by Cointreau including publishing your name on the Website or Cointreau’s social media.
i. You may promote Cointreau and the competition via social media but you agree to keep confidential any information and material of a confidential nature regarding Cointreau or the competition which come to your knowledge through your participation in the competition, including the identities of the ten finalists and eventual winner of the grant until they have been publicly announced by Cointreau.
i. If there is any reason to believe that there has been a breach of these terms and conditions Cointreau may, at its sole discretion, exclude you from participating in the competition, or withdraw the prize.
ii. Cointreau reserves the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.
iii. If a provision of these terms and conditions is or becomes invalid or unenforceable, that part shall not affect the validity of the other provisions in these terms and conditions, and shall be severed from those provisions.
iv. These terms and conditions shall be governed by South African law, and you submit to the exclusive jurisdiction of the courts of South Africa.

i. To contact Cointreau or to de-register and withdraw from the competition or any email updates from Cointreau, please email firstname.lastname@example.org . All of Cointreau’s emails to you will also have an opt-out link if you wish to unsubscribe from further updates.
All projects are welcome, you have carte blanche to express yourself and create yourself.
